What is a Lemon?
Under the Nebraska Lemon Law, a lemon is a new vehicle that has a substantial defect that cannot be fixed after a reasonable number of attempts. A substantial defect is one that:
- Impairs the use, value, or safety of the vehicle
- Cannot be fixed after a reasonable number of attempts
- Is not caused by the consumer's misuse or neglect

How to File a Lemon Law Claim
If you believe that you have a lemon, you should first contact the manufacturer of the vehicle. The manufacturer will have an opportunity to inspect the vehicle and attempt to repair the defect. If the manufacturer is unable to fix the defect after a reasonable number of attempts, you may be able to file a Lemon Law claim.
To file a Lemon Law claim, you must submit a written notice to the manufacturer. The notice must include the following information:
- Your name and address
- The year, make, and model of the vehicle
- The date of Free Download
- The mileage on the vehicle
- A description of the defect
- The number of attempts that have been made to repair the defect
- A copy of all repair Free Downloads
You should send the notice to the manufacturer's registered agent in Nebraska. The manufacturer's registered agent can be found on the Nebraska Secretary of State's website.
What Happens After You File a Lemon Law Claim
Once you have filed a Lemon Law claim, the manufacturer will have an opportunity to respond. The manufacturer may agree to replace or refund the vehicle. If the manufacturer does not agree to your request, you may be able to file a lawsuit.
If you win your lawsuit, you may be awarded:
- A replacement vehicle
- A refund of the Free Download price
- Reimbursement for your attorney fees
Time Limits
There are time limits for filing a Lemon Law claim. You must file your claim within two years of the date of Free Download or within one year of the date of the last repair attempt, whichever is later.
